We are pleased that you wish to use our services and thank you for your confidence in us. Please read the following General Contract and Travel Conditions carefully.

 

1. Scope

1.1 These Terms & Conditions govern the contractual relationship between you (the “Client” or “you”) and TASTINGS SAS (SIRET 979 767 860 00013, Code NAF/APE 9329Z) trading under the brand “Paris Wine Walks” (hereafter “PWW”, “we”, “us”, “our”) in respect of all tours, events, day-tours, long-duration tours (lasting more than one day), concierge services, private tours, group incentives and related services (collectively the “Services”). (Adapted from existing clause 1.1 and 1.2.)

1.2 These Terms & Conditions apply to all bookings made via our website, by email, telephone or other means, for Services offered by PWW whether to individuals, couples, families, private groups, corporate clients or incentive groups.

1.3 Where the description of a particular Service (on our website, brochure, quote, order confirmation or otherwise) states what is included and/or excluded, that description forms an integral part of the contract. All other services (e.g., extra meals, additional wines, optional excursions, upgrades, transfers, gratuities or other third-party services) are excluded unless expressly included.

2. Booking & Contract Formation

2.1 A contract is formed when (a) you submit a booking request for a Service, (b) we send you a confirmation (by email or other writing) accepting your booking request, and (c) you pay the required deposit or full payment as specified in the confirmation. Until we send the confirmation, the booking request is subject to availability and you have no contract.

2.2 You warrant that all information you provide to us (for you or your travelling party) is correct, complete and that you have the authority to contract for all persons named in the booking.

2.3 If your booking for a Service is part of a longer package (for example involving third-party providers), then you acknowledge that certain parts of the Services may be subject to those third-party providers’ terms (e.g., hotel accommodation, transport, restaurants). We will endeavour to pass on the relevant terms and fees to you.

3. Payment

3.1 Payment terms are set out in the booking confirmation. In general:

  • For standard day tours or wine walks, full payment is required at time of booking.

  • For private tours, long-duration tours, events, incentives or concierge-service bookings (which may require significant advance planning or third-party commitments), a deposit (typically 30 %–50 %) is required at the time of booking, with the balance due no later than 30 days before the Service start date (or earlier if specified).

3.2 If you fail to make any payment by the due date, we reserve the right to cancel your booking, treat it as a cancellation by you, and retain any deposit or cancellation fees as set out in clause 4 below.

3.3 All payments must be in Euros (unless otherwise agreed), and are non-refundable except as expressly stated in these Terms & Conditions.

4. Cancellation & Amendments by the Client

4.1 Standard (Open-Group) Tours / Wine Walks:

  • Cancellations made more than 30 days before the tour date: full refund (minus any non-reimbursable third-party costs).

  • Cancellations made 72 hours or less before the scheduled start: no refund.

  • If you cannot attend, you may substitute another person (subject to our consent), provided you notify us in writing at least 48 hours before the Service start; the substitute must meet any eligibility requirements, and you remain liable for the booking.

4.2 Private Tours, Long-Duration Tours, Events, Incentives & Concierge Services:

  • Cancellation 30 days or more before the start date: deposit refunded less any non-reimbursable third-party costs (minimum 30 % retained) or such other percentage as stated in your confirmation.

  • Cancellation between 29 days and 8 days before the start date: 50 % of the total cost is retained.

  • Cancellation 7 days or less before the start date: 100 % of the cost is retained (no refund).

  • For multi-day tours, each day’s delay or cancellation may trigger a separate fee as per detailed schedule in your confirmation.

4.3 Amendments by you: Any request by you to amend the booking (date, number of participants, itinerary) is subject to our written acceptance and may incur an amendment fee plus any additional costs (e.g., supplier fees). If you reduce the number of participants after the final minimum number was confirmed, our cancellation fee schedule may apply to the difference.

4.4 “No-show” of participants is treated as cancellation under clause 4.2 or 4.1 (as applicable) and no refund will be given for those participants.

5. Alterations & Cancellation by PWW

5.1 We reserve the right to modify or cancel the Service when necessary (for example due to weather, transport disruption, availability of suppliers, an event out of our control). Where we make a material change (e.g., change of date, time, major part of itinerary, accommodation) we will notify you as soon as possible.

5.2 If we cancel the Service before the start date (for reasons other than your breach) you may choose either:

(a) an alternative Service of equivalent standard (if available), or

(b) a full refund of amounts paid.

If you accept the alternative but the cost is lower, we will refund the difference.

5.3 If, after the start of a multi-day Service, we need to make a significant change or interruption due to our fault or a supplier’s fault (and cannot reasonably continue), we will refund the proportion of the Service not provided (based on cost) and be liable only under clause 7.

5.4 We cannot accept responsibility for changes or cancellations arising from events beyond our reasonable control (see clause 8.2 “Force Majeure”).

6. Participant Responsibilities, Health & Safety

6.1 You must notify us at time of booking of any special requirements, dietary restrictions, medical conditions, mobility issues or other conditions which could affect your ability to participate safely. For private tours or events we may require completion of a health/fitness form.

6.2 You must follow all instructions given by our staff, guides or suppliers, including safety guidance. Failure to do so may result in termination of your participation (with no refund) and you will be liable for any costs incurred.

6.3 You must ensure you hold valid travel documents, visas, health insurance (including emergency evacuation and repatriation), luggage insurance and personal accident/illness insurance (particularly for multi-day tours). We strongly recommend that you take out travel cancellation insurance.

6.4 PWW does not guarantee the absence of allergens or the presence of specific vegetarian/vegan options unless stated in the Service description. You accept any inherent risk associated with wine-tasting, food, walking, cycling or other tour activities.

6.5 For multi-day tours that include transport, accommodation or other third-party services, you must board vehicles when notified, be ready at times specified, and assume responsibility for your personal belongings, property and travel documents.

7. Liability

7.1 PWW is liable for death, bodily injury or illness resulting from our negligence (including that of our employees or agents) or from a supplier we have engaged.

7.2 Our liability for other direct material loss (where we are at fault) is limited to twice the cost of the Service booked (excluding optional extras) unless otherwise required by law. We exclude liability for indirect or consequential loss. Existing clause wording retained with clarification.

7.3 We disclaim liability for any loss, damage or expense incurred which is caused by:

(a) a third-party supplier not contracted by PWW;

(b) you (or any member of your party); (c) an event of force majeure (see below); (d) a circumstance you failed to disclose or in which you act negligently.

7.4 It is your responsibility to take out adequate travel insurance (including personal accident, illness, cancellation, loss of luggage, repatriation) and to carry any insurance documentation with you.

8. Force Majeure

8.1 We are not liable for any failure or delay in performing our obligations under the contract if such failure or delay is caused by an event beyond our reasonable control (a “Force Majeure Event”), including but not limited to: war, terrorism, riot, pandemic or epidemic, fire, flood, storm, earthquake, industrial dispute, transport failure, government regulation or shutdown.

8.2 In the event of Force Majeure, we may cancel or vary the Service and will notify you as soon as practicable. If the Service is cancelled prior to your travel start date, you may choose either a credit voucher (valid for 12 months) or a refund of amounts paid for the cancelled part of the Service (less non-reimbursable third-party costs). We shall have no additional liability to you.

9. Complaints & Dispute Resolution

9.1 If you have a complaint while on tour you must bring this immediately to the guide or relevant supplier so that we can endeavour to rectify the problem on the spot.

9.2 If the matter is not resolved locally you must submit a written complaint to us (by email to the address stated in your confirmation) within 30 days of the final date of the Service, setting out your booking reference and full details of your complaint. Failure to do so will extinguish any claim you may have.

9.3 Any dispute arising out of or in connection with these Terms & Conditions or your booking shall first be referred to mediation via MTV – Médiation Tourisme Voyage (BP 80303 – 75823 Paris Cedex 17) or any successor body, before recourse to the courts.

10. Applicable Law & Jurisdiction

10.1 These Terms & Conditions and the contract between you and PWW are governed by French law.

10.2 Any dispute shall be brought exclusively before the competent courts of Paris (Tribunal judiciaire de Paris), unless you prefer to bring proceedings before the consumer court in your place of residence (where applicable). Existing clause retained.

11. Transferability & Assignment

11.1 You may not assign or transfer your booking without our prior written consent (except as provided in clause 4.1 for substitution of a participant).

11.2 We may assign our rights and obligations under the contract to another company within the same group or to a third party, provided that the change does not adversely affect your rights under the contract.

12. Prices & Inclusions

12.1 The price of the Service is shown in Euros unless otherwise stated and is based on exchange rates, taxes, duties and suppliers’ tariffs in force at the time of quotation. We reserve the right to increase the price up to 20 days prior to the date of service if there is a change in: (a) transportation costs (including fuel), (b) dues, taxes or fees, (c) currency exchange rates, (d) number of participants (for group bookings) affecting cost.

12.2 If in the event of an increase the price goes up by more than 8 % of the total cost, you may cancel the booking within 14 days of notification and obtain a full refund of amounts paid.

12.3 Included: the confirmed itinerary, guide(s), tastings (as described), meals (if specified), transport (if specified), any listed extras. Excluded: everything that is not stated as included — e.g., transfers, gratuities, personal expenses, optional excursions unless specified.

13. Participants & Group Size

13.1 For open-group tours, a minimum number of participants may apply. If the minimum is not reached, we may cancel or convert to a private tour and notify you.

13.2 For private tours, incentives, events or concierge-services, you will be given a quote specifying minimum and maximum participant numbers, cancellation thresholds, any per-person or per-group pricing, and a detailed itinerary.

13.3 For large group incentives or corporate programmes, it is your responsibility to provide PWW with accurate numbers and any changes by the deadline specified. Late changes may incur additional charges, and if numbers drop below the minimum we reserve the right to apply cancellation fees or re-price the Service.

14. Intellectual Property & Marketing

14.1 All materials (including itineraries, maps, photographs, logos, guides’ commentary, website text) provided by PWW are and remain our intellectual property or that of our licensors. You may not reproduce, modify or distribute them without our prior written consent.

14.2 We may use photographs or video taken on our tours or events for marketing purposes, unless you request in writing at least 7 days in advance that you do not wish to be featured.

15. Privacy & Data Protection

15.1 We will collect, process and store personal data in accordance with our Privacy Policy, which is available on our website.

15.2 By confirming your booking, you consent to our processing of your personal data as set out in the Privacy Policy and to our sharing of relevant data with our suppliers for the performance of the Services.

16. Health, Accessibility & Special Requests

16.1 If you have accessibility needs, mobility limitations or other special requirements (dietary, medical, etc.), you must notify us at time of booking so we may reasonably accommodate. We will endeavour to meet such requests but cannot guarantee full compliance unless explicitly stated in your Service description.

16.2 Any such accommodation may incur additional cost, which will be notified to you in your quote or confirmation.

17. Behaviour & Conduct

17.1 You and your party must behave responsibly and follow the instructions of our guides or other service providers. We reserve the right to refuse or terminate participation (with no refund) for any participant whose behaviour is clearly inappropriate, dangerous, intoxicated or violates the rights of others.

17.2 You remain responsible for the actions of your party, for any damage caused to property, and for any additional costs incurred as a result of misconduct (e.g., late cancellation, extra cleaning, repair or third-party claims).

18. Voucher & Gift Certificates

18.1 If you book a Service with a voucher or gift certificate, then the same Terms & Conditions apply. Vouchers are valid for the period stated on the voucher or as otherwise notified, and are non-transferable except by prior written approval of PWW.

18.2 Expiry of the voucher without booking will result in forfeiture (unless we agree otherwise).

18.3 If we cancel your Service booked via voucher we shall provide a replacement Service of equal value or a refund to the original buyer, unless stated otherwise.

19. Amendment of Terms & Conditions

19.1 We may amend or update these Terms & Conditions from time to time. The version published on our website at the date of booking will apply to your contract, unless we expressly agree that a later version applies.

20. Severability

20.1 If any provision of these Terms & Conditions is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
